Ingabire’s Co-Accused Want to be Set Free from Jail

{{Three former Soldiers namely Lt-Col. Tharcisse Nditurende, Maj. Vital Uwumuremyi and Lt-Col. Noel Habiyaremye co-accused with Victoire Ingabire Umuhoza have requested their release from the prison saying that they have all served their sentences.}}

The prosecution disagrees because this claim against all three defendants includes the period in which they were imprisoned illegally.

Another Capt. Karuta JMV who was sentenced to two years and seven months is currently released.

The defendants Lt-Col. Nditurende and Maj. Uwumuremyi have to serve a sentence of 3 years and 6 months with 1 year probation while Lt-Col. Habiyaremye was sentenced to 4 years and 6 months with one year suspended.

The debate over the circumstances of their arrest and release resurfaced on 25th March while reappearing in the Supreme Court in the appeal trial of Ingabire.

The problem arises when both Lt. Col. Nditurende and Lt. Col. Noel Habiyaremye revealed that they were arrested on 22nd September 2009 in Burundi, however, the prosecution said although they were arrested on that date, they were legally sentenced on 24 October 2010.

Lt-Col.Nditurende said after their transfer from Burundi to Rwanda, they were jailed seven months in Camp Kami asking the judges to do their job to order their release.

The Supreme Court has decided that it will respond to this request March 28, 2013.
