Illegal dismissal of employees costs government Rwf 900 million

{An analysis conducted by Rwanda public service commission indicated that the government has lost almost Rwf 900 million since 2009 till 2015 over illegal decisions taken while dismissing employees.}

The first analysis indicates that since 2009 till 2012, the government of Rwanda lost Rwf 296, 416, 380 and USD 32,920 while from 2012 to 2015 the government lost Rwf 528, 556, 779 and USD 17, 400, totaling Rwf 864 573 166.

The public service commission demonstrates that the loss resulted from the money government compensated to employees who won against illegal indictments in which they accused the government .Cases in which employees won cases against the government include illegal dismissal of employees and sacking employees with disregard to signed contracts.

This was unveiled yesterday during the meeting of the commission of public service with leaders from various institutions including ministries, partners and institutions working closely and responsible for solving citizens’ problems. The meet was also aimed at sharing ideas on achievements to come up with common resolutions for what went wrong.

In recent three years, 50 public institutions were accused by 264 employees in 150 court hearings while 83 government institutions were brought to courts by 184 employees from 2009 to 2012.

The report indicates that government institutions lost the court cases over illegal processes of penalties, misusing laws and unlawful procedure of trial, promotions and failure to pay arrears.

The comparison between the two analyses conducted by the Ministry of Public Service Labor shows that the amount lost by the government in litigations have increased.

The president of commissioners in the public service commission, François Habiyakare says that it is a worrying problem even though there is no deep analysis to point to the real cause of losses.

“We feel worried of such losses but no analysis indicates the cause. However the cause may be attributed to the increasing number of employees bringing the government to courts,” he said.

He says that more audits will be undertaken adding that causers of government losses must be penalized accordingly.

A total of 32 government institutions emerged in the two analysis where they were twice taken to court.

In a press briefing held last year, the Minister Of Justice, Johnston Busingye said that they had established regulations that individuals whose inept performance results in taking government to courts of law will bear the consequences.
