They argue that these former soldiers have lost their status as military and therefore military courts are incompetent to rule on their case.
The Prosecution disclaims all kind of incompetence by saying that there was complicity with active military, Colonel Tom Byabagamba, so the military court has capacity to rule on their case.
After deliberation, the military court conducting the trial of the defendants as to whether they should be provisionally released or remanded in custody, has decided that it is perfectly competent to conduct the trial in which they are accused of spreading rumors and campaign of civil disobedience, illegal gun port and unfair criticism of the regime.
