New Oscar revelations won’t count

Pistorius was found guilty last month of killing Steenkamp,although Judge Thokozile Masipa ruled it was unintentional.

The Blade Runner shot Steenkamp after he mistook her for an intruder. The state argued the killing was premeditated and as a result of an argument.

Commenting on the new revelations, criminal lawyer Ulrich Roux said the information would have no bearing on the remainder of the trial.

“It can’t have an impact as it is not evidence which has been led before court. Neither parties can use or refer to this information for sentencing as the evidence was not led before court.”

He said prosecutor Gerrie Nel had put it to Pistorius that he was speaking to his ex-girlfriend, but it would have been speculation to say what they were talking about.

“It would have had no effect on what happened later that evening as there was no proof to show that Steenkamp and Pistorius had argued that night.”

Speaking about the synching of Pistorius’s cellphone with his brother’s laptop and the alleged deletion of data, Roux said it would have had an impact only if the state could have proved that the information had been intentionally erased.

“If there are grounds for these revelations and it’s the truth then it’s the state’s loss,” he said.
