{"id":249,"date":"2011-06-20T16:19:35","date_gmt":"2011-06-20T16:19:35","guid":{"rendered":"https:\/\/new.igihe.com\/french\/bernard-munyagishari-plaide-non-coupable-249\/"},"modified":"2011-06-20T16:19:06","modified_gmt":"2011-06-20T16:19:06","slug":"bernard-munyagishari-plaide-non-coupable","status":"publish","type":"post","link":"https:\/\/new.igihe.com\/french\/bernard-munyagishari-plaide-non-coupable\/","title":{"rendered":"Bernard Munyagishari plaide non coupable"},"content":{"rendered":"<p><em>Bernard <span data-scaytid=\"1\" data-scayt_word=\"Munyagishari\">Munyagishari<\/span>, pr\u00e9sum\u00e9 <span data-scaytid=\"4\" data-scayt_word=\"g\u00e9nocidaire\">g\u00e9nocidaire<\/span>&nbsp;des <span data-scaytid=\"5\" data-scayt_word=\"Tutsi\">Tutsi<\/span> en&nbsp;1994, a plaid\u00e9 non coupable lors de sa pr\u00e9sentation lundi devant le Tribunal p\u00e9nal international pour le <span data-scaytid=\"6\" data-scayt_word=\"Rwanda\">Rwanda<\/span> (<span data-scaytid=\"10\" data-scayt_word=\"TPIR\">TPIR<\/span>).<\/em><\/p>\n<p>Arr\u00eat\u00e9 le 24 mai dans l\u2019est de la <span data-scaytid=\"15\" data-scayt_word=\"RDC\">RDC<\/span> o\u00f9 il se cachait, Bernard <span data-scaytid=\"2\" data-scayt_word=\"Munyagishari\">Munyagishari<\/span>, a \u00e9t\u00e9 transf\u00e9r\u00e9 au <span data-scaytid=\"11\" data-scayt_word=\"TPIR\">TPIR<\/span> \u00e0 <span data-scaytid=\"16\" data-scayt_word=\"Arusha\">Arusha<\/span>, en <span data-scaytid=\"17\" data-scayt_word=\"Tanzanie\">Tanzanie<\/span>, le 14 juin.<br \/>Ancien pr\u00e9sident des miliciens <span data-scaytid=\"18\" data-scayt_word=\"Interahamwe\">Interahamwe<\/span> dans&nbsp;la ville de <span data-scaytid=\"19\" data-scayt_word=\"Gisenyi\">Gisenyi<\/span> (nord-ouest du <span data-scaytid=\"7\" data-scayt_word=\"Rwanda\">Rwanda<\/span>), <span data-scaytid=\"3\" data-scayt_word=\"Munyagishari\">Munyagishari<\/span> \u00e9tait recherch\u00e9 depuis 2005.<\/p>\n<p>&#8220;Je plaide non coupable&#8221;, a-t-il d\u00e9clar\u00e9 \u00e0 la lecture de chacun des chefs d\u2019accusation port\u00e9s contre lui&nbsp;: entente en vue de commettre le g\u00e9nocide, g\u00e9nocide ou alternativement complicit\u00e9 de g\u00e9nocide, assassinats et viols.<\/p>\n<p>Le juge <span data-scaytid=\"20\" data-scayt_word=\"Dennis\">Dennis<\/span> <span data-scaytid=\"21\" data-scayt_word=\"Byron\">Byron<\/span>, qui pr\u00e9sidait l\u2019audience, lui a promis un proc\u00e8s \u00e9quitable, l\u2019assurant qu\u2019il b\u00e9n\u00e9ficierait de la pr\u00e9somption d\u2019innocence aussi longtemps que sa culpabilit\u00e9 ne serait pas prouv\u00e9e au-del\u00e0 de tout doute raisonnable.<\/p>\n<p>Le procureur <span data-scaytid=\"22\" data-scayt_word=\"Hassan\">Hassan<\/span> <span data-scaytid=\"23\" data-scayt_word=\"Bubacar\">Bubacar<\/span> <span data-scaytid=\"24\" data-scayt_word=\"Jallow\">Jallow<\/span> a cependant d\u00e9j\u00e0 annonc\u00e9 qu\u2019il avait l\u2019intention de d\u00e9poser devant les juges une demande de renvoi de cette affaire vers un pays qu\u2019il n\u2019a pas nomm\u00e9.<\/p>\n<p>Les chambres du tribunal sont actuellement saisies de trois requ\u00eates visant \u00e0 transf\u00e9rer des accus\u00e9s vers les tribunaux <span data-scaytid=\"26\" data-scayt_word=\"rwandais\">rwandais<\/span>.<br \/>Selon <span data-scaytid=\"25\" data-scayt_word=\"Jallow\">Jallow<\/span>, &#8220;la strat\u00e9gie de renvois d\u2019affaires vers des juridictions nationales reste cruciale&#8221; pour le respect des d\u00e9lais impartis par le Conseil de s\u00e9curit\u00e9 qui a demand\u00e9 avec insistance au <span data-scaytid=\"12\" data-scayt_word=\"TPIR\">TPIR<\/span> de terminer tous ses travaux en 2014.<\/p>\n<p>Les cinq premi\u00e8res demandes de renvoi d\u2019affaires vers le <span data-scaytid=\"8\" data-scayt_word=\"Rwanda\">Rwanda<\/span> avaient \u00e9t\u00e9 rejet\u00e9es par les juges du <span data-scaytid=\"13\" data-scayt_word=\"TPIR\">TPIR<\/span>, au motif que toutes les conditions d\u2019un proc\u00e8s \u00e9quitable n\u2019y \u00e9taient pas encore r\u00e9unies.<\/p>\n<p>Dans les trois nouvelles requ\u00eates d\u00e9pos\u00e9es en novembre 2010, le procureur assure que le <span data-scaytid=\"9\" data-scayt_word=\"Rwanda\">Rwanda<\/span> remplit aujourd\u2019hui toutes les conditions.<\/p>\n<p>Selon <span data-scaytid=\"27\" data-scayt_word=\"l\u2019AFP\">l\u2019AFP<\/span>,de qui nous tenons cette information,jusqu\u2019\u00e0 pr\u00e9sent, seules deux proc\u00e9dures de renvoi ont r\u00e9ussi, \u00e0 destination de la France. Elles concernaient deux accus\u00e9s r\u00e9sidant en France et qui n\u2019ont d\u2019ailleurs jamais \u00e9t\u00e9 transf\u00e9r\u00e9 au <span data-scaytid=\"14\" data-scayt_word=\"TPIR\">TPIR<\/span>&nbsp;: l\u2019abb\u00e9 <span data-scaytid=\"28\" data-scayt_word=\"Wenceslas\">Wenceslas<\/span> <span data-scaytid=\"29\" data-scayt_word=\"Munyeshyaka\">Munyeshyaka<\/span> et l\u2019ancien pr\u00e9fet de <span data-scaytid=\"30\" data-scayt_word=\"Gikongoro\">Gikongoro<\/span> , en province du Sud, <span data-scaytid=\"31\" data-scayt_word=\"Laurent\">Laurent<\/span> <span data-scaytid=\"32\" data-scayt_word=\"Bucyibaruta\">Bucyibaruta<\/span>.<\/p>\n<p>Paris, qui s\u2019est vu confier les deux dossiers fin 2007, m\u00e8ne ses propres enqu\u00eates mais les proc\u00e8s n\u2019ont pas encore d\u00e9marr\u00e9.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Bernard Munyagishari, pr\u00e9sum\u00e9 g\u00e9nocidaire&nbsp;des Tutsi en&nbsp;1994, a plaid\u00e9 non coupable lors de sa pr\u00e9sentation lundi devant le Tribunal p\u00e9nal international pour le Rwanda (TPIR).
