{"id":108,"date":"2011-05-17T13:00:00","date_gmt":"2011-05-17T13:00:00","guid":{"rendered":"https:\/\/new.igihe.com\/french\/le-fils-de-kobagaya-premier-temoin-a-la-barre-108\/"},"modified":"2011-05-17T12:59:38","modified_gmt":"2011-05-17T12:59:38","slug":"le-fils-de-kobagaya-premier-temoin-a-la-barre","status":"publish","type":"post","link":"https:\/\/new.igihe.com\/french\/le-fils-de-kobagaya-premier-temoin-a-la-barre\/","title":{"rendered":"Le fils de Kobagaya, premier t\u00e9moin \u00e0 la barre pour d\u00e9fendre son p\u00e8re"},"content":{"rendered":"<p><em>Le fils de <span data-scaytid=\"1\" data-scayt_word=\"Lazare\">Lazare<\/span> <span data-scaytid=\"2\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span>, l\u2019homme accus\u00e9 d\u2019avoir menti aux agents de l\u2019immigration am\u00e9ricaine au sujet de sa participation dans le g\u00e9nocide des <span data-scaytid=\"12\" data-scayt_word=\"Tutsi\">Tutsi<\/span> de 1994, a t\u00e9moign\u00e9 ce lundi dans le proc\u00e8s de son p\u00e8re.<\/em><\/p>\n<p>Son t\u00e9moignage Jean Claude <span data-scaytid=\"16\" data-scayt_word=\"Kandagaye\">Kandagaye<\/span> s\u2019est focalis\u00e9 sur leur vie en tant que r\u00e9fugi\u00e9s <span data-scaytid=\"21\" data-scayt_word=\"burundais\">burundais<\/span> au <span data-scaytid=\"23\" data-scayt_word=\"Rwanda\">Rwanda<\/span> et les efforts de son p\u00e8re des ann\u00e9es plus tard pour devenir un citoyen am\u00e9ricain.<\/p>\n<p>L\u2019homme de 84 ans, qui vit <span data-scaytid=\"27\" data-scayt_word=\"\u00e0Topeka\">\u00e0Topeka<\/span>, dans l\u2019Etat de <span data-scaytid=\"28\" data-scayt_word=\"Kansas\">Kansas<\/span>, est accus\u00e9 d\u2019avoir ill\u00e9galement obtenu la citoyennet\u00e9 am\u00e9ricaine en 2006. Il aurait cach\u00e9 son r\u00f4le dans la perp\u00e9tration du g\u00e9nocide qui visait \u00e0 exterminer les <span data-scaytid=\"13\" data-scayt_word=\"Tutsi\">Tutsi<\/span> en 1994.<\/p>\n<p>L\u2019acte d\u2019accusation vise \u00e9galement \u00e0 r\u00e9voquer sa citoyennet\u00e9 am\u00e9ricaine si jamais M.&nbsp;<span data-scaytid=\"3\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> est reconnu coupable.<\/p>\n<p>Le proc\u00e8s <span data-scaytid=\"4\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> est une premi\u00e8re dans ce pays qui n\u2019avait jamais organis\u00e9 et jug\u00e9 un proc\u00e8s pour g\u00e9nocide dans son histoire.<br \/>&nbsp;<br \/><span data-scaytid=\"17\" data-scayt_word=\"Kandagaye\">Kandagaye<\/span> a dit dans son <span data-scaytid=\"29\" data-scayt_word=\"temoignage\">temoignage<\/span> que son p\u00e8re est un <span data-scaytid=\"30\" data-scayt_word=\"Hutu\">Hutu<\/span> et sa m\u00e8re est une <span data-scaytid=\"14\" data-scayt_word=\"Tutsi\">Tutsi<\/span>. Aux jur\u00e9s <span data-scaytid=\"18\" data-scayt_word=\"Kandagaye\">Kandagaye<\/span> a dit que, m\u00eame s\u2019il a grandi au <span data-scaytid=\"24\" data-scayt_word=\"Rwanda\">Rwanda<\/span>, sa famille a \u00e9t\u00e9 victime de discrimination <span data-scaytid=\"31\" data-scayt_word=\"parce\">parce<\/span> qu\u2019ils \u00e9taient des r\u00e9fugi\u00e9s <span data-scaytid=\"22\" data-scayt_word=\"burundais\">burundais<\/span>. Et en tant que r\u00e9fugi\u00e9s, ils ne pouvaient pas adh\u00e9rer \u00e0 un parti politique, fr\u00e9quenter des \u00e9coles publiques secondaires ou obtenir des emplois et des services sociaux.<\/p>\n<p><span data-scaytid=\"19\" data-scayt_word=\"Kandagaye\">Kandagaye<\/span> a dit aux jur\u00e9s que, \u00e9tant r\u00e9fugi\u00e9, son p\u00e8re ne pouvait pas \u00eatre un chef de la milice <span data-scaytid=\"33\" data-scayt_word=\"rwandaise\">rwandaise<\/span> dans le village de <span data-scaytid=\"34\" data-scayt_word=\"Birambo\">Birambo<\/span> o\u00f9 ils vivaient &#8211; un argument cl\u00e9 que l\u2019\u00e9quipe de la d\u00e9fense tente d\u2019utiliser contrer les all\u00e9gations du gouvernement am\u00e9ricain selon lesquelles <span data-scaytid=\"5\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> \u00e9t\u00e9 un chef influent de la milice pendant le g\u00e9nocide.<\/p>\n<p>Plus t\u00f4t ce lundi, les procureurs ont termin\u00e9 leur plaidoyer apr\u00e8s avoir entendu l\u2019agent d\u2019immigration qui a interview\u00e9 <span data-scaytid=\"6\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> lors de sa demande de citoyennet\u00e9 en avril 2006.<\/p>\n<p>L\u2019agent des services de l\u2019immigration <span data-scaytid=\"35\" data-scayt_word=\"Jeryl\">Jeryl<\/span> <span data-scaytid=\"36\" data-scayt_word=\"Bean\">Bean<\/span> a t\u00e9moign\u00e9 que <span data-scaytid=\"7\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> a r\u00e9pondu \u00ab&nbsp;non&nbsp;\u00bb lorsqu\u2019on lui a demand\u00e9 s\u2019il avait particip\u00e9 dans le g\u00e9nocide ou commis un crime pour lequel il n\u2019a pas \u00e9t\u00e9 condamn\u00e9.<\/p>\n<p><span data-scaytid=\"8\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> a \u00e9galement ni\u00e9 avoir donn\u00e9 de fausses informations aux agents d\u2019immigration ou avoir mentir pour gagner l\u2019entr\u00e9e aux \u00c9tats-Unis.<\/p>\n<p>Les procureurs ont utilis\u00e9 le t\u00e9moignage de <span data-scaytid=\"37\" data-scayt_word=\"Bean\">Bean<\/span> pour contrer l\u2019objection de la d\u00e9fense selon laquelle <span data-scaytid=\"9\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span>, involontairement, aurait ni\u00e9 devant les agents de l\u2019immigration avoir v\u00e9cu au <span data-scaytid=\"25\" data-scayt_word=\"Rwanda\">Rwanda<\/span> pendant le g\u00e9nocide des <span data-scaytid=\"15\" data-scayt_word=\"Tutsi\">Tutsi<\/span> en 1994 <span data-scaytid=\"32\" data-scayt_word=\"parce\">parce<\/span> qu\u2019il n\u2019\u00e9tait pas familier avec la langue anglaise. Ainsi il aurait mal compris les questions sur le formulaire de l\u2019immigration, a pr\u00e9tendu la d\u00e9fense.<\/p>\n<p>La d\u00e9fense a poursuivi en disant que c\u2019\u00e9tait l\u2019un de ses fils, <span data-scaytid=\"20\" data-scayt_word=\"Kandagaye\">Kandagaye<\/span>, qui a effectivement rempli les papiers car <span data-scaytid=\"10\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> ne parlait pas <span data-scaytid=\"39\" data-scayt_word=\"anglais\">anglais<\/span> \u00e0 l\u2019\u00e9poque.<\/p>\n<p>Toutefois, l\u2019agent <span data-scaytid=\"38\" data-scayt_word=\"Bean\">Bean<\/span> a dit aux jur\u00e9s que <span data-scaytid=\"11\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> parlait <span data-scaytid=\"40\" data-scayt_word=\"anglais\">anglais<\/span> et qu\u2019aucun membre de la famille ou interpr\u00e8te n\u2019\u00e9tait pr\u00e9sent lors de l\u2019entrevue de 2006 pour&nbsp;acqu\u00e9rir la citoyennet\u00e9 am\u00e9ricaine.<\/p>\n<p>Une vingtaine de t\u00e9moins sont attendus \u00e0 ce proc\u00e8s que la presse am\u00e9ricaine qualifie d\u2019historique.
