French author Guillaume Apollinaire\u2019s book, \u201cThe Exploits of Young Don Juan\u201d (Les exploits d\u2019un jeune Don Juan), gives detailed accounts of \u201cunnatural sexual intercourse\u201d and offers no \u201cform of a plotline\u201d, according to the court, and therefore was not protected under freedom of speech laws.<\/p>\n
Sel Publishing\u2019s owner \u0130rfan Sanc\u0131 and translator \u0130smail Yerguz were initially taken to court over the explicit nature of the book following its release, but an Istanbul court granted them an acquittal, describing the book as a work of literature.<\/p>\n
The Supreme Court, however, overturned the ruling on the grounds that freedom of speech had to include \u201ca sense of responsibility\u201d, instead demanding that Sanc\u0131 and Yerguz be tried on charges that carry a possible sentence of between six and 10 years.<\/p>\n
\u201cDuring the exercise of freedoms, one has to act with a sense of responsibility, and such freedoms are subject to limitations that aim to preserve order and protect society\u2019s morals and general health,\u201d the court stated.<\/p>\n
The book aims to \u201cexploit and arouse the sexual desires and harm the modesty of society\u201d and contains \u201cvulgar and simple language\u201d, the court added.<\/p>\n
