{"id":91,"date":"2011-05-02T12:35:07","date_gmt":"2011-05-02T12:35:07","guid":{"rendered":"https:\/\/new.igihe.com\/rwandan-rebel-leaders-due-in-court-in-germany\/"},"modified":"2011-05-02T12:34:47","modified_gmt":"2011-05-02T12:34:47","slug":"rwandan-rebel-leaders-due-in-court-in-germany","status":"publish","type":"post","link":"https:\/\/new.igihe.com\/english\/rwandan-rebel-leaders-due-in-court-in-germany\/","title":{"rendered":"Rwandan rebel leaders due in court in Germany"},"content":{"rendered":"<p><strong>Two senior Rwandan <span data-scaytid=\"1\" data-scayt_word=\"Hutu\">Hutu<\/span> rebel leaders go on trial Wednesday accused of masterminding from Germany atrocities in the eastern Democratic Republic of Congo (DRC).<\/strong><\/p>\n<p>In the dock in the southwestern German city of Stuttgart are <span data-scaytid=\"3\" data-scayt_word=\"Ignace\">Ignace<\/span> <span data-scaytid=\"4\" data-scayt_word=\"Murwanashyaka\">Murwanashyaka<\/span>, 47, the head of the &#8220;terrorist&#8221; Democratic Forces for the Liberation of Rwanda (<span data-scaytid=\"7\" data-scayt_word=\"FDLR\">FDLR<\/span>), and his deputy <span data-scaytid=\"15\" data-scayt_word=\"Straton\">Straton<\/span> <span data-scaytid=\"16\" data-scayt_word=\"Musoni\">Musoni<\/span>, 49.<\/p>\n<p>Justice minister <span data-scaytid=\"123\" data-scayt_word=\"Tharcisse\">Tharcisse<\/span> <span data-scaytid=\"113\" data-scayt_word=\"Karugarama\">Karugarama<\/span> has hailed Germans continued efforts to prosecute the two Rwandan genocide fugitives&nbsp;<\/p>\n<p>Before their arrest in Germany in November 2009, the two ordered mass killings and rapes from Germany together with a third man living in France who has been extradited to the International Criminal Court (ICC), prosecutors say.<\/p>\n<p>They will face 26 counts of crimes against humanity and 39 counts of war crimes committed by militias under their command between January 2008 and the date of their arrest.<\/p>\n<p>Those crimes\u2019 foundation in international law dates back to the Nuremberg trials of top Nazis after World War II.<\/p>\n<p>The United Nations hailed the trial as a breakthrough after repeated calls by the Security Council to bring <span data-scaytid=\"8\" data-scayt_word=\"FDLR\">FDLR<\/span> commanders living abroad to justice and to bar them from unleashing further violence in the strife-wracked eastern DRC.<\/p>\n<p>&#8220;This cooperative burden-sharing in prosecuting individuals for serious international crimes will greatly advance the fight against impunity,&#8221; UN Secretary General Ban <span data-scaytid=\"18\" data-scayt_word=\"Ki-moon\">Ki-moon<\/span> said in January.<\/p>\n<p>&#8220;Legal action against <span data-scaytid=\"9\" data-scayt_word=\"FDLR\">FDLR<\/span> leaders also reinforces efforts to demobilize and repatriate <span data-scaytid=\"10\" data-scayt_word=\"FDLR\">FDLR<\/span> fighters, which would significantly contribute to stabilizing the eastern DRC.&#8221;<\/p>\n<p>A resident of Germany for two decades, <span data-scaytid=\"5\" data-scayt_word=\"Murwanashyaka\">Murwanashyaka<\/span> studied in the western city of Bonn and was afforded asylum, settling in Mannheim in the southwest. He is married to a German woman.<\/p>\n<p><span data-scaytid=\"17\" data-scayt_word=\"Musoni\">Musoni<\/span>, his right-hand man since 2004, has lived in Germany since 1994.<\/p>\n<p>Prosecutors say <span data-scaytid=\"19\" data-scayt_word=\"Murwananshyaka\">Murwananshyaka<\/span> ordered around 200 killings and &#8220;large numbers&#8221; of rapes by his <span data-scaytid=\"22\" data-scayt_word=\"milititas\">milititas<\/span>, had them use civilians as &#8220;human shields&#8221; and sent child soldiers into battle in eastern DRC.<\/p>\n<p>&#8220;I am the president and&#8230; the supreme commander&#8221; of the <span data-scaytid=\"11\" data-scayt_word=\"FDLR\">FDLR<\/span>, &#8220;I know exactly what is happening&#8221; on the ground, he told German media in interviews in 2008 and 2009.<\/p>\n<p>A UN report counted 240 telephone calls between <span data-scaytid=\"20\" data-scayt_word=\"Murwananshyaka\">Murwananshyaka<\/span>, known as the &#8220;The Doctor&#8221; for his PhD in economics, and his officers during the same period.<\/p>\n<p>A <span data-scaytid=\"23\" data-scayt_word=\"protege\">protege<\/span> of former DRC president Laurent-Desire <span data-scaytid=\"24\" data-scayt_word=\"Kabila\">Kabila<\/span>, <span data-scaytid=\"21\" data-scayt_word=\"Murwananshyaka\">Murwananshyaka<\/span> also paid occasional visits to his troops in the country\u2019s dense forests, according to the UN.<\/p>\n<p>At the time of their arrest, the rebel group said that the two were &#8220;in no way involved in the atrocities committed against civilians in eastern DRC,&#8221; calling their detention &#8220;unfair and unjustified.&#8221;<\/p>\n<p>The trial is to run until at least July.<\/p>\n<p>The <span data-scaytid=\"12\" data-scayt_word=\"FDLR\">FDLR<\/span> was created by the perpetrators of the 1994 Rwandan genocide, who fled to <span data-scaytid=\"25\" data-scayt_word=\"neighbouring\">neighbouring<\/span> DRC after President Paul <span data-scaytid=\"26\" data-scayt_word=\"Kagame\">Kagame<\/span> took power.<\/p>\n<p>Its around 5,000 <span data-scaytid=\"2\" data-scayt_word=\"Hutu\">Hutu<\/span> fighters are seen as a major source of instability in Africa\u2019s resource-rich Great Lakes region.<\/p>\n<p><span data-scaytid=\"27\" data-scayt_word=\"Kagame\">Kagame<\/span> has <span data-scaytid=\"28\" data-scayt_word=\"criticised\">criticised<\/span> Western countries in the past for not doing enough to bring <span data-scaytid=\"13\" data-scayt_word=\"FDLR\">FDLR<\/span> leaders to justice, and the UN mission in DRC, known as <span data-scaytid=\"29\" data-scayt_word=\"MONUSCO\">MONUSCO<\/span>, has called on other countries to follow the example set by France and Germany.<\/p>\n<p><span data-scaytid=\"6\" data-scayt_word=\"Murwanashyaka\">Murwanashyaka<\/span>, head of the <span data-scaytid=\"14\" data-scayt_word=\"FDLR\">FDLR<\/span> since 2001, was among 15 people whose assets were frozen by the Security Council in 2005 on suspicion of involvement in war crimes.<\/p>\n<p>He had been arrested but later released in Germany in 2006 due to a lack of witnesses for the prosecution. Germany declined a request to extradite him to Rwanda in 2008 but later launched another inquiry.<\/p>\n<p>Prosecutors said they questioned witnesses in Africa &#8220;in very difficult conditions&#8221; with the aid of the UN and non-governmental <span data-scaytid=\"30\" data-scayt_word=\"organisations\">organisations<\/span>.<\/p>\n<p>In January, a former mayor, <span data-scaytid=\"31\" data-scayt_word=\"Onesphore\">Onesphore<\/span> <span data-scaytid=\"32\" data-scayt_word=\"Rwabukombe\">Rwabukombe<\/span>, went on trial in Germany charged with ordering and <span data-scaytid=\"33\" data-scayt_word=\"organising\">organising<\/span> during the Rwandan genocide the killing of at least 3,730 <span data-scaytid=\"34\" data-scayt_word=\"Tutsis\">Tutsis<\/span> who had sought refuge in church buildings.<\/p>\n<p><p>France is holding a third alleged senior leader in the <span data-scaytid=\"51\" data-scayt_word=\"FDLR\">FDLR<\/span>, <span data-scaytid=\"72\" data-scayt_word=\"Callixte\">Callixte<\/span> <span data-scaytid=\"73\" data-scayt_word=\"Mbarushimana\">Mbarushimana<\/span>, who faces a trial at the International Criminal Court in The Hague.
