{{Safari Kizito a lawyer representing Cecile Kayirebwa a celebrated music icon has expressed his dissatisfaction against the delay of a case involving his client and Rwandair.}}<\/p>\n
The lawyer told IGIHE, \u201cDelayed justice is denied justice,\u201d he said court is draging its feet in handling the case {Kayirebwa Vs Rwandair}.<\/p>\n
Kayirebwa in September 2012 filed a lawsuit at the Nyagurenge, Commercial High Court against {Rwandair} for failing to adhere to provisions of a contract the two parties had entered requiring {Rwandair } to use some of her music in the launch of its activities but broke the agreement.<\/p>\n
{Rwandair } had submitted that it didn\u2019t abuse the contract thus requested the court to provide them with time to find music experts to help in proving that the audio music used in the promotion works of {Rwandair} was not of Cecile kayirebwa.<\/p>\n
The defendant ({Rwandair}) had submitted two persons as music experts including Albert Rudatsimburwa and Irene Habemenshi. <\/p>\n
Rwandair is challenging the authenticity of the recordings. <\/p>\n
Court kicked out Rudatsimburwa on grounds that he had previously been accused along other media houses of playing her copyrighted music \u201cfor years\u201d without her permission and also failing to pay her loyalties.<\/p>\n
Meanwhile Habamenshi refused to present herself as a music expert in the case of Cecile {Kayirebwa Vs Rwandair.}<\/p>\n
After failure to find other music experts in three requests sought by the defendant, court fined {Rwandair } Frw200,000 for failing to present a music expert and wasting time. <\/p>\n
Kayirebwa is seeking undisclosed damages from {Rwandair} for breaching the contract.<\/p>\n
The Music icon had entered an agreement with {Rwandair} to use her song Inzozi Nziza in launching the activities of {Rwandair}.<\/p>\n
