{"id":3980,"date":"2012-11-07T04:04:00","date_gmt":"2012-11-07T04:04:00","guid":{"rendered":"https:\/\/new.igihe.com\/tsvangirai-still-married-to-locardia-lawyer\/"},"modified":"2012-11-07T04:17:30","modified_gmt":"2012-11-07T04:17:30","slug":"tsvangirai-still-married-to-locardia-lawyer","status":"publish","type":"post","link":"https:\/\/new.igihe.com\/english\/tsvangirai-still-married-to-locardia-lawyer\/","title":{"rendered":"Tsvangirai Still Married to Locardia"},"content":{"rendered":"<p>{{Zimbabwean Prime Minister Morgan Tsvangirai is still customarily married to Ms Locardia Kari\u00admatsenga and the out-of-court settlement struck by the couple was restricted to mainte\u00adnance issues.}} <\/p>\n<p>Prominent lawyer Mr Jonathan Samu-kange, who is acting for Ms Karimat\u00adsenga, yesterday said the settlement reached by the parties last month was simply a once-off maintenance payment. <\/p>\n<p>Divorce, if need be, would be separate pro\u00adceedings.<\/p>\n<p>Mr Samukange said there was confusion on Ms Karimatsenga\u2019s marital status that needs to be clarified.<\/p>\n<p>\u201cMy client is still married to (Mr) Tsvangi\u00adrai. We have only agreed on maintenance issues. We got a good figure that we are not at liberty to disclose.<\/p>\n<p>\u201c(Mr) Tsvangirai has not paid gupuro and the marriage was never terminated. As we speak, Locardia is still Tsvangirai\u2019s wife. To prove that Tsvangirai is still married to my client, the agreement compels him to person\u00adally go to his in-laws with three oxen,\u201d he said.<\/p>\n<p>Part of the agreement reached by the par\u00adties read: \u201cThe first party (PM Tsvangirai) shall pay to the second party (Ms Karimat\u00adsenga) a lump sum payment. The second party acknowledges receipt of such payment.<\/p>\n<p>\u201cIn addition, the first party shall further deliver three oxen to the second party\u2019s par\u00adents in fulfilment of cultural requirements.<\/p>\n<p>\u201cThe litigation between the parties (in whatever court commenced or pending) shall be withdrawn.<\/p>\n<p>\u201cThe parties agree that this agreement is a full and final settlement and no obligation shall be due from one party to the other nei\u00adther shall any rights accrue in favour of any one of the parties arising from the relation\u00adship which existed between them and whose termination they acknowledge.\u201d<\/p>\n<p>Mr Samukange and PM Tsvangirai\u2019s lawyer, Mr Innocent Chagonda, appended their sig\u00adnatures as witnesses to the agreement.<\/p>\n<p>Ms Karimatsenga and her lawyer, Mr Samukange, signed the agreement on Octo\u00adber 31 while PM Tsvangirai and Mr Chagonda signed the following day.<\/p>\n<p>Mr Samukange said he warned PM Tsvan\u00adgirai\u2019s lawyer against bringing the oxen in the sacred month of November.<\/p>\n<p>\u201cMr Chagonda informed me that the oxen were ready for delivery, but I warned him against bringing them in November. <\/p>\n<p>\u201cI stopped him because we do not want to con\u00adtinue offending our customs considering that the marriage took place the same time last year.<br \/>\n\u201cThey have to wait until December. We do not want to offend our custom,\u201d said Mr Samukange.<\/p>\n<p>A Harare magistrate recently found that PM Tsvangirai paid lobola to Ms Karimat\u00adsenga\u2019s parents after viewing a video record\u00ading of the event.<\/p>\n<p>PM Tsvangirai was denying ever marrying Ms Karimatsenga until Harare provincial magistrate Mr Munamato Mutevedzi played the recording during an inquiry on whether or not the premier should be allowed to marry Ms Elizabeth Macheka under Chapter 5:11 of the Marriages Act.<\/p>\n<p>The finding showed that the PM was in a polygamous marriage and he was barred from proceeding with the planned civil mar\u00adriage. <\/p>\n<p>Mr Samukange is on record stating that his client was comfortable in a polygamous marriage and that she was actually the senior wife to the PM.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>{{Zimbabwean Prime Minister Morgan Tsvangirai is still customarily married to Ms Locardia Kari\u00admatsenga and the out-of-court settlement struck by the couple was restricted to mainte\u00adnance issues.}} Prominent lawyer Mr Jonathan Samu-kange, who is acting for Ms Karimat\u00adsenga, yesterday said the settlement reached by the parties last month was simply a once-off maintenance payment.
