{"id":2000112662,"date":"2026-05-21T07:23:00","date_gmt":"2026-05-21T05:23:00","guid":{"rendered":"https:\/\/new.igihe.com\/english\/?p=2000112662"},"modified":"2026-05-21T11:17:04","modified_gmt":"2026-05-21T09:17:04","slug":"how-international-justice-failed-the-victims-of-felicien-kabuga","status":"publish","type":"post","link":"https:\/\/new.igihe.com\/english\/how-international-justice-failed-the-victims-of-felicien-kabuga\/","title":{"rendered":"How international justice failed the victims of F\u00e9licien Kabuga"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Kabuga, who passed away while in IRMCT custody on Saturday, May 16, at the age of 91, is not the first genocide perpetrator to die without facing trial. Kabuga died while maintaining his presumption of innocence, despite the serious allegations against him. But the evidence of his criminal past related to the Genocide remains.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That evidence was such that for more than two decades, Kabuga engaged in a relentless, globe-spanning effort to evade justice. After the ICTR issued its first sealed indictment against him in 1997, he went into hiding, employing a network of associates, family members, and bribed officials.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He moved constantly across several countries, including Kenya, Switzerland (where he had business interests), and the Democratic Republic of Congo, all under false identities. He used multiple aliases, changed his appearance, and relied on a web of safe houses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For nearly 23 years, he evaded capture, at times living openly in affluent Nairobi suburbs, where he was protected by corrupt local authorities and well-paid security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Interpol issued a red notice, and his name appeared on the US State Department\u2019s most-wanted list, yet he remained free. He was finally arrested in Asni\u00e8res-sur-Seine, near Paris, on May 16, 2020, after French authorities acted on a tip-off. By then, he had spent the better part of three decades outrunning justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The past from which he was running was well known. Being one of the richest men before and during the Genocide, Kabuga was a shadowy figure behind the scenes, using his wealth to implement the plan to exterminate the Tutsi in Rwanda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kabuga imported the bulk of machetes and other crude weapons that were used to exterminate more than one million Tutsi. Kabuga was also among the founders of Radio T\u00e9l\u00e9vision Libre des Mille Collines (RTLM), and Kangura Magazine, the genocidal propaganda machines that broadcasted and published hate speech and incited violence against the Tutsi population.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kabuga&#8217;s name has echoed through the halls of justice in numerous cases tried by the ICTR, including the first trial, when Jean Paul Akayesu, former mayor of Taba Commune, was standing trial. Witnesses and survivors came forward, providing testimony about his pivotal role in the genocide. Val\u00e9rie Bemeriki, a journalist with RTLM, testified that Kabuga played a key role in RTLM programmes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The evidence against him was overwhelming, and for a moment following his arrest, it seemed that justice might finally be served. But that glimmer of hope was extinguished with the unexpected verdict to halt the trial. On September 8, 2023, judges indefinitely suspended proceedings after ruling that Kabuga was unfit to stand trial due to his health condition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision sent shockwaves through the international community, leaving victims and survivors of the 1994 Genocide against the Tutsi reeling with a sense of betrayal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The international justice system had, once again, failed the victims. This failure echoed previous issues of early releases granted to top convicted g\u00e9nocidaires by Judge Theodor Meron.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the time of Kabuga\u2019s death, the IRMCT said arrangements were still being sought for his provisional release to a country willing to receive him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His case will remain in history as one of the greatest failures of international justice.
