{"id":198,"date":"2011-05-17T10:30:38","date_gmt":"2011-05-17T10:30:38","guid":{"rendered":"https:\/\/new.igihe.com\/kobagaya-defence-calls-son-as-1st-witness\/"},"modified":"2011-05-17T10:27:07","modified_gmt":"2011-05-17T10:27:07","slug":"kobagaya-defence-calls-son-as-1st-witness","status":"publish","type":"post","link":"https:\/\/new.igihe.com\/english\/kobagaya-defence-calls-son-as-1st-witness\/","title":{"rendered":"Kobagaya: Defence calls son as 1st witness"},"content":{"rendered":"<p><p><strong>The son of<br \/>\na man accused of lying to immigration officials about his participation in the<br \/>\n1994 Rwandan genocide took the stand Monday to testify about their life as<br \/>\nBurundian refugees in Rwanda and his father\u2019s efforts years later to become a<br \/>\n<span data-scaytid=\"1\" data-scayt_word=\"U.S\">U.S<\/span>. citizen.<\/strong><o:p><\/o:p><\/p>\n<p><strong><\/p>\n<p><\/strong><\/p>\n<p>That testimony came as the <span data-scaytid=\"7\" data-scayt_word=\"defence\">defence<\/span> team for <span data-scaytid=\"11\" data-scayt_word=\"Lazare\">Lazare<\/span> <span data-scaytid=\"12\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> began<br \/>\nlaying out its case. The 84-year-old Topeka, Kansas, man is charged with<br \/>\nunlawfully obtaining <span data-scaytid=\"2\" data-scayt_word=\"U.S\">U.S<\/span>. citizenship in 2006 and with fraud and misuse of an<br \/>\nalien registration card. The indictment also seeks to revoke his citizenship.<o:p><\/o:p><\/p>\n<\/p>\n<p>Prosecutors have said the case is the first in the <span data-scaytid=\"3\" data-scayt_word=\"U.S\">U.S<\/span>. requiring<br \/>\nproof of genocide. An estimated 500,000 to 800,000 people, mostly ethnic<br \/>\n<span data-scaytid=\"20\" data-scayt_word=\"Tutsis\">Tutsis<\/span>, were killed by <span data-scaytid=\"21\" data-scayt_word=\"Hutu\">Hutu<\/span> militias in Rwanda between April and July 1994.<o:p><\/o:p><\/p>\n<\/p>\n<p>Jean Claude <span data-scaytid=\"23\" data-scayt_word=\"Kandagaye\">Kandagaye<\/span> testified that his father is a <span data-scaytid=\"22\" data-scayt_word=\"Hutu\">Hutu<\/span> and his<br \/>\nmother is a Tutsi. <span data-scaytid=\"24\" data-scayt_word=\"Kandagaye\">Kandagaye<\/span> told jurors that while he was growing up in<br \/>\nRwanda, his family was discriminated against because they were Burundian<br \/>\nrefugees. As refugees, they could not join political parties, attend public<br \/>\nsecondary schools or get some jobs and social services.<o:p><\/o:p><\/p>\n<\/p>\n<p><span data-scaytid=\"25\" data-scayt_word=\"Kandagaye\">Kandagaye<\/span> told jurors that as a refugee his father was not a<br \/>\nleader in the Rwandan village of <span data-scaytid=\"28\" data-scayt_word=\"Birambo\">Birambo<\/span> where they lived \u2014 a key point as the<br \/>\n<span data-scaytid=\"8\" data-scayt_word=\"defence\">defence<\/span> team tries to counter the government\u2019s allegations that <span data-scaytid=\"13\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> was an<br \/>\ninfluential community leader who led others during the genocide.<o:p><\/o:p><\/p>\n<\/p>\n<p><span data-scaytid=\"26\" data-scayt_word=\"Kandagaye\">Kandagaye<\/span>, who filled out an immigration form in 2005 for his<br \/>\nfather, is considered a key witness as the <span data-scaytid=\"9\" data-scayt_word=\"defence\">defence<\/span> tries to show jurors that the<br \/>\nelderly <span data-scaytid=\"14\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> did not understand English well and depended on others to<br \/>\ntranslate documents and help him fill out immigration paperwork.<o:p><\/o:p><\/p>\n<\/p>\n<p>Earlier Monday, prosecutors rested their case after putting on the<br \/>\nstand the immigration official who interviewed <span data-scaytid=\"15\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> during his citizenship<br \/>\napplication in April 2006.<o:p><\/o:p><\/p>\n<\/p>\n<p>Adjudication officer <span data-scaytid=\"29\" data-scayt_word=\"Jeryl\">Jeryl<\/span> Bean testified that <span data-scaytid=\"16\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> responded<br \/>\n&#8220;no&#8221; when asked whether he had ever persecuted anyone or ever<br \/>\ncommitted any crimes for which he was not convicted. <span data-scaytid=\"17\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> also denied ever<br \/>\ngiving false information to immigration officials or lying to them to gain<br \/>\nentry into the United States, she testified.<o:p><\/o:p><\/p>\n<\/p>\n<p>Prosecutors used Bean to attack <span data-scaytid=\"30\" data-scayt_word=\"Kobagaya\u2019s\">Kobagaya\u2019s<\/span> claim that he did not<br \/>\npurposefully misrepresent to immigration officials that he was not living in<br \/>\nRwanda during the 1994 genocide because he was unfamiliar with the English<br \/>\nlanguage and may have misunderstood that question on the immigration forms.<o:p><\/o:p><\/p>\n<\/p>\n<p>The <span data-scaytid=\"10\" data-scayt_word=\"defence\">defence<\/span> has argued that it was one of his sons, <span data-scaytid=\"27\" data-scayt_word=\"Kandagaye\">Kandagaye<\/span>, who<br \/>\nactually filled out the paperwork because <span data-scaytid=\"18\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> did not speak English at the<br \/>\ntime.<o:p><\/o:p><\/p>\n<\/p>\n<p>However, Bean told jurors that <span data-scaytid=\"19\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> spoke English and that no<br \/>\ninterpreter or family member was present during the 2006 interview for his<br \/>\ncitizenship.<o:p><\/o:p><\/p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The son of a man accused of lying to immigration officials about his participation in the 1994 Rwandan genocide took the stand Monday to testify about their life as Burundian refugees in Rwanda and his father\u2019s efforts years later to become a U.S. citizen.
