{"id":128,"date":"2011-05-06T09:48:46","date_gmt":"2011-05-06T09:48:46","guid":{"rendered":"https:\/\/new.igihe.com\/witness-identifies-kobayaga-as-taking-part-in\/"},"modified":"2011-05-06T09:41:47","modified_gmt":"2011-05-06T09:41:47","slug":"witness-identifies-kobayaga-as-taking-part-in","status":"publish","type":"post","link":"https:\/\/new.igihe.com\/english\/witness-identifies-kobayaga-as-taking-part-in\/","title":{"rendered":"Witness identifies Kobayaga as taking part in genocide attack"},"content":{"rendered":"<p><p><strong>A<br \/>\nwoman whose husband and three young children were slaughtered during the 1994<br \/>\nRwandan genocide cried Thursday as she identified from the witness stand the<br \/>\nKansas man she contends led a mob attack up a mountain where she and many<br \/>\nothers had sought refuge from the ethnic carnage that was sweeping Rwanda.<\/strong><o:p><\/o:p><\/p>\n<p><strong><\/p>\n<p><\/strong><\/p>\n<p>Her<br \/>\naccount was the most emotional yet as the trial of <span data-scaytid=\"5\" data-scayt_word=\"Lazare\">Lazare<\/span> <span data-scaytid=\"6\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> entered its<br \/>\nfifth day of testimony in a federal courtroom in Wichita in the <span data-scaytid=\"76\" data-scayt_word=\"U.S\">U.S<\/span>. The government is<br \/>\nseeking to revoke his <span data-scaytid=\"77\" data-scayt_word=\"U.S\">U.S<\/span>. citizenship for allegedly lying to immigration<br \/>\nauthorities about his involvement in the genocide.<o:p><\/o:p><\/p>\n<p>The<br \/>\n84-year-old Topeka man is charged with unlawfully obtaining <span data-scaytid=\"2\" data-scayt_word=\"U.S\">U.S<\/span>. citizenship in<br \/>\n2006 with fraud and misuse of an alien registration card in a case prosecutors<br \/>\nhave said is the first in the United States requiring proof of genocide.<br \/>\n<span data-scaytid=\"7\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> contends he is innocent.<o:p><\/o:p><\/p>\n<p>Valerie<br \/>\n<span data-scaytid=\"14\" data-scayt_word=\"Niyitegeka\">Niyitegeka<\/span>, a Tutsi woman whose family farmed near <span data-scaytid=\"17\" data-scayt_word=\"Kobagaya\u2019s\">Kobagaya\u2019s<\/span> village,<br \/>\nrecounted for jurors the events of April 15, 1994, when she, her husband,<br \/>\n<span data-scaytid=\"18\" data-scayt_word=\"Appolloni\">Appolloni<\/span>, and their six children fled as mobs of <span data-scaytid=\"11\" data-scayt_word=\"Hutu\">Hutu<\/span> men burned Tutsi houses.<\/p>\n<p><o:p><\/o:p><\/p>\n<p>&#8220;I<br \/>\nwas OK for my house to be burned \u2014 as long as I am not dead,&#8221; she<br \/>\ntestified through a translator.<o:p><\/o:p><\/p>\n<p><span data-scaytid=\"15\" data-scayt_word=\"Niyitegeka\">Niyitegeka<\/span><br \/>\ndetailed how she climbed \u2014 and at times crawled \u2014 up the steep, rocky mountainside<br \/>\nof Mount <span data-scaytid=\"22\" data-scayt_word=\"Nyakizu\">Nyakizu<\/span> with her youngest son strapped to her back. She described how<br \/>\nthe women and children gathered piles of stones for their men to throw as mobs<br \/>\nof <span data-scaytid=\"23\" data-scayt_word=\"Hutus\">Hutus<\/span> attacked.<o:p><\/o:p><\/p>\n<p>She<br \/>\ntold jurors she was able to identify the elderly <span data-scaytid=\"8\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> as the leader of the<br \/>\nattacking mob because she recognized the way he walked and the cane he carried<br \/>\nthat day. She pointed at him in the courtroom&nbsp;: &#8220;He is there. He is the<br \/>\none.&#8221;<o:p><\/o:p><\/p>\n<p>The<br \/>\ndefense tried to cast doubt on that identification by noting trees and other<br \/>\nobstructions on the mountain that day.<o:p><\/o:p><\/p>\n<p>During<br \/>\nthe melee as the family fled the mountain in the ensuing days, <span data-scaytid=\"16\" data-scayt_word=\"Niyitegeka\">Niyitegeka<\/span> was<br \/>\nseparated from her husband and three of her children. She testified she would<br \/>\nnever see them alive again. Their slain children\u2019s ages were 12, 10 and 8.<o:p><\/o:p><\/p>\n<p>Joseph<br \/>\n<span data-scaytid=\"25\" data-scayt_word=\"Yandagiye\">Yandagiye<\/span>, a 76-year-old <span data-scaytid=\"12\" data-scayt_word=\"Hutu\">Hutu<\/span> farmer, testified about what happened to the<br \/>\nchildren and their father, who sought refuge at <span data-scaytid=\"33\" data-scayt_word=\"Yandagiye\u2019s\">Yandagiye\u2019s<\/span> house. After taking<br \/>\nthem in, <span data-scaytid=\"26\" data-scayt_word=\"Yandagiye\">Yandagiye<\/span> went to run some errands. When he returned, he said he found<br \/>\na crowd of <span data-scaytid=\"24\" data-scayt_word=\"Hutus\">Hutus<\/span> had already surrounded his house.<o:p><\/o:p><\/p>\n<p><span data-scaytid=\"27\" data-scayt_word=\"Yandagiye\">Yandagiye<\/span><br \/>\ntestified that when the crowd threatened him in an attempt to get into the<br \/>\nhouse, <span data-scaytid=\"19\" data-scayt_word=\"Appolloni\">Appolloni<\/span> came out and told the mob&nbsp;: &#8220;Take me instead.&#8221;<o:p><\/o:p><\/p>\n<p><span data-scaytid=\"28\" data-scayt_word=\"Yandagiye\">Yandagiye<\/span><br \/>\nalso told jurors he initially followed the mob that had taken <span data-scaytid=\"20\" data-scayt_word=\"Appolloni\">Appolloni<\/span> and his<br \/>\nchildren, but turned back after they told him they would make him kill them<br \/>\nhimself if he continued to follow.<o:p><\/o:p><\/p>\n<p>Later<br \/>\nthat day, a group of <span data-scaytid=\"13\" data-scayt_word=\"Hutu\">Hutu<\/span> men came to get him too, <span data-scaytid=\"29\" data-scayt_word=\"Yandagiye\">Yandagiye<\/span> testified. It was<br \/>\nthen that he learned that <span data-scaytid=\"21\" data-scayt_word=\"Appolloni\">Appolloni<\/span> and his children had been killed.<o:p><\/o:p><\/p>\n<p><span data-scaytid=\"30\" data-scayt_word=\"Yandagiye\">Yandagiye<\/span><br \/>\ntestified that <span data-scaytid=\"9\" data-scayt_word=\"Kobagaya\">Kobagaya<\/span> told the mob that they should kill him too because he<br \/>\nhad sheltered <span data-scaytid=\"34\" data-scayt_word=\"Tutsis\">Tutsis<\/span> in his house during a 1959 conflict. <span data-scaytid=\"31\" data-scayt_word=\"Yandagiye\">Yandagiye<\/span> said<br \/>\nanother community leader, Francois <span data-scaytid=\"35\" data-scayt_word=\"Bazaramba\">Bazaramba<\/span>, urged the crowd not to kill him<br \/>\nbut to punish <span data-scaytid=\"32\" data-scayt_word=\"Yandagiye\">Yandagiye<\/span> by making him buy beer, which he did.<o:p><\/o:p><\/p>\n<p><span data-scaytid=\"36\" data-scayt_word=\"Bazaramba\">Bazaramba<\/span><br \/>\nis a former Rwandan pastor who was sentenced last year to life imprisonment by<br \/>\na Finnish court for committing genocide.<o:p><\/o:p><\/p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A woman whose husband and three young children were slaughtered during the 1994 Rwandan genocide cried Thursday as she identified from the witness stand the Kansas man she contends led a mob attack up a mountain where she and many others had sought refuge from the ethnic carnage that was sweeping Rwanda.
