In a statement, the Minister announced that those dismissed will not be admitted in any other justice sector-related job.
“Through Ministerial Order N◦136/MOJ/AG/2018 of 18/07/2018, the Ministry of Justice has permanently dismissed six Professional Bailiffs for serious professional misconduct. The Dismissal means that they can’t get admitted to any other profession in the Rwandan Justice sector permanently,” a statement reads.
Dismissed are Febronie Ayinkamiye, Epimaque Mutesa, Juvenal Nyirimbibi, Alexis Mutunzi, Roger David Sebahire and Michel Muhire.
Article 43 of the Law N° 12/2013 of 22/03/2013 governing the Bailiff Function in Rwanda states that when court bailiffs fail to accomplish their responsibilities they are verbally warned followed with a written warning, temporary suspension for a period from one month to six months and dismissal from the profession.
Article 46 says that reasons for the temporary suspension or dismissal of a professional bailiff are unlawful auction of the seized property, getting involved in corruption, embezzling the seized property or anything offered as a bribe.
The article says that a court bailiff will be dismissed from job when sentenced to a term of imprisonment equal to or exceeding six months, serious professional mistakes due to misconduct, accessing fraudulently to the profession of bailiff and being characterized by discrimination while exercising his/her duties.
